In this privacy notice, we, Plaston Holding AG based in Widnau, Switzerland (hereinafter also "us", "our" and "we"), explain how we obtain and process personal data in the context of our business activities and on our website (www.plaston.com ; hereinafter "Website"), in particular personal data about our customers, suppliers, business partners, professional and other associations, users of our Website, visitors, participants in events, recipients of newsletters, job applicants and other bodies or their respective contact persons and employees (hereinafter also "you").
If you provide us with data about other persons (e.g. employees, work colleagues), we assume that you are authorized to do so and that this data is correct and that you have ensured that these persons are informed about the disclosure (e.g. by informing them in advance of this privacy notice).
I. Controller of the processing of your personal data
Plaston AG, Espenstrasse 85, CH-9443 Widnau is the controller of the data processing, which is described in this privacy notice.
II. Sources through which we collect personal data
We primarily process the personal data that you disclose to us yourself (e.g. as part of your business relationship or communication with us) or that is collected by your end device when you use our electronic services (e.g. our website).
In addition, we may, within the permitted limits, also collect personal data in relation with the purposes mentioned under Section III from third parties, in particular from:
- group companies, which refers to the following companies: Plaston AG, Plaston CR s.r.o., Plaston Precision Injection Moulding (Jiaxing) Co., Ltd., Boneco AG, Boneco Trading (Jiaxing) Co., Ltd.
- publicly accessible sources, such as commercial and debt collection registers, the media or the Internet (including social media);
- your employer or principal with whom we have a business relationship or are otherwise involved (e.g. to gather references in connection with a job application);
- persons who act on your behalf (e.g. representatives, consultants, etc.);
- authorities (including courts and other dispute resolution authorities); and
- other third parties, such as employment agencies, credit reference agencies, address traders, associations, contractual partners, internet analytical services, persons involved in proceedings that we are conducting (e.g. counterparties, legal representatives, witnesses, experts, etc.).
This includes in particular the personal data that we process in the context of the initiation, conclusion and execution of contracts as well as data from correspondence and discussions with third parties, but also all other categories of data in accordance with Section III below.
III. Purposes for which we process your personal data and legal basis
We collect and process your personal data primarily for the following purposes:
- initiation and conclusion of contracts with you or your principal or employer, for which we may in particular process personal data such as your name, contact details, powers of attorney, declarations of consent, information about third parties (e.g. contact persons), contract content, creditworthiness data and all other data that you provide to us or that we collect via the sources mentioned in Section II;
- recruitment of employees in order to review job applications, carry out application procedures and - in the event of a successful application - for the preparation and conclusion of a contract. In addition to your name, contact details, date of birth, marital status, social security data and the information from the respective communication, this includes in particular personal data that you provide to us in connection with an application process and that we collect from third parties for this purpose (e.g. professional background, training and further education, references and data from public sources such as social media);
- administration and performance of contracts with our customers and other contractual partners (e.g. suppliers, service providers, project partners) in order to provide and claim the contractual services. This includes data processing for customer support as well as the enforcement of contracts and safeguard of claims (debt collection, legal proceedings, etc.), accounting and, to the extent permitted, public communication. For this purpose, we process the data received or collected as part of the initiation and conclusion of the contract (e.g. data on contractual obligations and their performance, financial and payment information and the other information specified in the bullet point "initiation and conclusion of contracts") as well as data that we create as part of our contractual services or that we collect from public sources or from other third parties in accordance with Section II. II (e.g. minutes of meetings, notes, internal and external correspondence, contractual documents, order history, documents that we create and receive as part of proceedings before authorities, as well as invoices); and
- compliance with regulatory requirements, such as laws, industry standards, directives, recommendations from authorities, internal regulations, etc.
The legal basis for the processing of your personal data for the above-mentioned purposes is the initiation and performance of a contract and the fulfilment of our legal obligations.
In addition, we also process personal data of you and other persons for the following purposes, to the extent permitted and where we deem it appropriate, in which we (and sometimes also third parties) have a legitimate interest corresponding to the purpose, which is the legal basis for the respective processing of your personal data:
- communication with you and in particular the third parties named in Section II via e-mail, the contact form on our Website, our social media channels, telephone, letter or other means (e.g. to answer inquiries, as part of the consultation and contract initiation and/or performance ). For this purpose, we process in particular the content of the communication, your contact details, the marginal data of the communication (when using the contact form on our Website, for example, we collect the IP address, date and time of sending) as well as image and audio recordings of (video) telephone calls. If we also need to establish your identity, we collect additional personal data (e.g. a copy of your identity card);
- marketing, advertising and relationship management, e.g. to send our business partners and other interested parties personalized advertising (whether in printed form, by e-mail or other electronic channels) regarding products, services and other news or in connection with marketing campaigns such as events and competitions. For this purpose, we process in particular the names, addresses (including e-mail addresses), telephone numbers or other contact details that we receive in the context of the initiation or performance of a contract or in the case of any newsletter or other registration. You can refuse such contacts at any time, in particular by refusing or withdrawing your consent to be contacted for advertising purposes (see end of this Section III for further information);
- market research and offer development (including improvement of our products, services and our other (electronic) offerings), for which we amongst others collect data about your behaviour and preferences. For example, we may analyse how you navigate through our Website, interact with our other electronic offering such as social media profiles or which products and services are used by which groups of people and in what way;
- operation of the infrastructure (including our IT and our electronic offering such as the Website), in particular we collect the data as set out in Section XI in order to be able to operate our Website securely and stably and use cookies;
- registration, if this is necessary in order to be able to use certain offers and services (e.g. free WIFI, newsletter), for which we collect and process the personal data provided during registration. Registration takes place either directly with us or via external login service providers;
- maintenance of security in order to ensure the appropriate security (e.g. combating crime and fraud) of our infrastructure (e.g. buildings), IT and our electronic offering (e.g. Website) and to continuously improve it. This includes monitoring and control measures with regard to access to our IT systems and physical access to our premises, analyses and tests of our IT systems as well as system and error checks. In addition, we may also keep logs and access logs (e.g. visitor lists) and use surveillance systems (e.g. security cameras) for documentation and security purposes (as a precautionary measure and to investigate incidents);
- risk and business management, including in particular protection against crime, business organization (e.g. resource planning) and corporate development (e.g. acquisition and sale of business units or companies); and
- other purposes, including in particular training and education purposes, administrative purposes (e.g. bookkeeping) or the organization of events. We may also process personal data for the organization, staging and follow-up of events, in particular lists of participants, content of presentations and discussions as well as (still and moving) images and audio recordings made during these events. The protection of other legitimate interests is another purpose, which may not be listed exhaustively.
If we ask for your consent for certain processing, we will inform you separately about the corresponding purposes of the processing. In this case, we process your personal data within the scope of and based on this consent, unless we have another legal basis, if required. You can withdraw your consent at any time with effect for the future by notifying us in writing (by post) or, unless otherwise stated or agreed, by e-mail. Kindly refer to Section X for our contact details. Once we have received notification of the withdrawal of your consent, we will no longer process your data for the purposes to which you originally consented, unless we have another legal basis for doing so (e.g. legal obligation or overriding interest). The withdrawal of your consent does not affect the lawfulness of processing based on consent before its withdrawal.
IV. Obligation to provide personal data
You must provide the personal data that is required for the establishment and performance of a business relationship and the fulfilment of the associated contractual obligations as part of our business relationship. This is because without this data we are generally not in a position to conclude or perform a contract with you (or the entity or person you represent). Similarly, our Website cannot be used if certain information for securing data traffic (e.g. IP address) is not disclosed. As a rule, however, there is no legal obligation to provide us with data.
V. Disclosure of personal data to third parties
Within the scope of the purposes mentioned in Section III, we may in particular transfer your personal data to the following categories of recipients:
- group companies: This refers to the following companies: Plaston AG, Plaston CR s.r.o., Plaston Precision Injection Moulding (Jiaxing) Co., Ltd., Boneco AG, Boneco Trading (Jiaxing) Co., Ltd. These group companies may use your personal data as described in this privacy notice for the same purposes as we do in accordance with Section III. The group companies usually process the data under their own responsibility ((joint) controller);
- service providers: We work with service providers who process personal data about you on our behalf or under joint responsibility (joint controller) with us or who receive data about you from us under their own responsibility (controller; e.g. IT and host providers, advertising service providers, banks, insurance companies, auditing companies, credit reference agencies, debt collection agencies, address verifiers, consulting firms (including lawyers), shipping service providers and the third parties mentioned in Section XI who collect data about you through our Website);
- business and cooperation partners: e.g. customers and contractual partners (especially if you work for them or they provide services for you), suppliers, subcontractors, marketing and project partners and other entities with whom we cooperate. This primarily relates to situations in which the transfer of your data is related to a contract. The business and cooperation partners generally process the personal data under their own responsibility (controller);
- public authorities: We may disclose personal data to authorities, official bodies and courts if this is necessary for the performance of a contract or if we are legally obliged or entitled to do so, or if this appears necessary to protect our legitimate interests. The authorities process data about you that they receive from us on their own responsibility (controller); and
- other persons/entities: This refers to other cases where the inclusion of third parties arises from the purposes set out in Section III, e.g. delivery addressees or payment recipients specified by you, your representatives (e.g. legal representatives, bank), industry organizations, associations and other bodies, other parties in potential or actual legal and other proceedings, as well as acquirers or parties interested in acquiring business unites, companies or other parts of us, which may also result in the disclosure of personal data (including from you, e.g. as a client or supplier or as their representative) to the persons involved in these transactions. If we work with the media and send them material (e.g. photos), you may also be affected.
The aforementioned categories of recipients may in turn involve third parties, as a result of which your personal data may also become accessible to them. We may restrict the processing by certain third parties (e.g. IT providers), but not by other third parties (e.g. authorities, banks, etc.).
In addition, we also allow certain third parties to collect personal data from you on our Website and at events on their own responsibility (processor; e.g. press photographers, providers of services that we have integrated on our Website, etc.). These third parties are solely responsible for the corresponding data processing, unless we are involved in a decisive way. Please therefore contact the respective third parties directly if you have any concerns and to assert your data protection rights (see Section IX). Information on the activities on our Website can be found in Section XI.
VI. Transfer of personal data abroad
We process and store personal data mainly in Switzerland and the European Economic Area (EEA). However, the recipients to whom we transfer your personal data in accordance with Section V (e.g. our group companies, service providers and their subcontractors) may also be located outside the EEA. This applies in particular with regard to the services integrated on our Website (see Section XI). For this reason, you must expect your personal data to be transferred to all countries where our group companies and the third parties retained by us are located.
If a recipient is located in a country without adequate statutory data protection, we contractually oblige the recipient to comply with an adequate data protection standard, e.g. by agreeing the EU standard contractual clauses (available at: https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj?) with the additions required for Switzerland, unless (i) the recipient is already subject to a legally recognized set of rules to ensure data protection or (ii) we may rely on an exception for specific cases. Such an exception exists, for example, in the case of legal proceedings abroad, but also in cases of overriding public interests or if the execution of a contract that is in your interest requires such disclosure, if you have given your consent or if it concerns data that you have made generally accessible and whose processing you have not objected to.
VII. Data security
We take appropriate security measures to protect the confidentiality, integrity and availability of your personal data, to protect it against unauthorized or unlawful processing and to counteract the risks of loss, unintended alteration or disclosure, or unauthorized access.
Please note that the communication tools and technologies we use (e.g. e-mail, video conferencing) do not offer complete protection of transmitted messages or content against data security risks. In particular, we may not exclude the possibility that third parties may access data transmitted via these channels and collect and use it for their own purposes. If you communicate with us via these channels yourself and without reservation or do not expressly object to such communication, we assume that you consent to communication via the respective channels.
VIII. Retention periods
We process your data for as long as our processing purposes, the statutory retention periods and our legitimate interests in processing for documentation and evidence purposes require or storage is technically necessary (e.g. in the case of backups or document management systems). In particular, business communication or concluded contracts must be stored for up to 10 years.
IX. Right to information, deletion and correction
The data protection law applicable to you grants you various rights in connection with the processing of your personal data, including the right to access your personal data, the right to have incorrect personal data corrected or deleted, the right to restrict processing, the right to object to data processing (in particular for direct marketing purposes) and other legitimate interests in processing) and the right to have certain personal data handed over for transfer to another body (data portability). These rights are subject to conditions, restrictions or exceptions (e.g. to protect third parties or business secrets). We reserve the right to assert these rights, for example if we are under an obligation to store or process certain data, if we have an overriding interest in doing so (insofar as we are entitled to invoke this) or if we need the data to assert claims. We also reserve the right to redact copies for data protection reasons or to only transmit excerpts. We will inform you in advance if you will incur any costs. With regard to the possibility of withdrawing your consent, please refer to Section III at the end.
You also have the right to lodge a complaint with the data protection supervisory authority in your country. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).

XI. Data that we process in connection with our website and other electronic offering
In connection with our electronic offering, in particular our Website, we use the technologies listed below.
1. Website and log files
Each time our Website is visited, our system automatically collects data and information from the system of the accessing device.
The following data is collected:
· information about the browser type and version used
· the operating system you are using
· your IP address
· date and time of access
· websites from which your system accesses our website W
· websites that are accessed by your system via our Website
· Name of page accessed by the user's system
The data is also stored in the log files of our system. This does not affect your IP address or other data that allows the data to be assigned to your person. This data is not stored together with other personal data.
Temporary storage of the IP address by the system is necessary to enable delivery of the Website to your device. For this purpose, your IP address must remain stored for the duration of the session.
Data is stored in log files to ensure the functionality of the Website. In addition, we use the data to optimize the Website and to ensure the security of our information technology systems.
The above-mentioned purposes do at the same time constitute our legitimate interest in the data processing.
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the Website, this is the case when the respective session has ended.
If the data is stored in log files, this is the case after 4 weeks at the latest, unless the purpose requires a longer storage period, e.g. for the investigation and prosecution of criminal offenses. Storage beyond this period is possible. In this case, your IP addresses will be deleted or anonymized so that they can no longer be associated with you.
The collection of data and storage in log files is absolutely necessary for the operation of the Website. Consequently, there is no possibility to object against related processing of personal data.

Our Website uses cookies. Cookies are text files that are stored in the Internet browser or by the Internet browser on your device. When you access a website, a cookie may be stored on your operating system. We use the consent management service CookieHub of CookieHub ehf, Hafnargata 55, 230 Reykjanesbær, Iceland (hereinafter "CookieHub") on our Website to obtain your consent to the storage of certain cookies in your browser or to the use of certain technologies and to document this consent in accordance with data protection regulations. For this purpose, CookieHub automatically creates a cookie banner for visitors to our Website. In addition, CookieHub scans and evaluates all cookies on our Website. b. Google Analytics
We use Google Analytics, a web analytics service provided by Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland and Google Inc, 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA (hereinafter "Google"). Google Analytics uses methods that enable the analysis of the use of our Website, e.g. cookies. These generate information about your use of the Website, such as
· navigation path of the users of our Website
· time spent on the Website (including subpages)
· subpage on which the Website is left
· country, region or city from which our Website is accessed
· device used (type, version, colour depth, resolution, width and height of the browser window)
· browser provider (including version) and the operating system used
· whether it is a returning or new user
· website that was visited before visiting our Website (referrer URL)
· host name of the accessing device (IP address)
· time of the server request
This information is transferred to Google servers in the USA and stored there. The IP address is shortened by activating IP anonymization ("anonymizeIP") on our Website before transmission within the member states of the European Union or in other contracting states of the Agreement on the European Economic Area, as well as in Switzerland. The anonymized IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. In these cases, we ensure that Google complies with an adequate level of data protection through contractual guarantees, in particular by agreeing the EU standard contractual clauses and additional measures.
We use this information for the purpose of evaluating the use of our Website, compiling reports on website activity and providing other services relating to website activity and Internet usage for the purposes of market research and tailoring our Website to meet user needs. Google may transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. According to Google, the IP address is not associated with other data relating to the user.
The legal basis for processing the data for the aforementioned purposes is your consent, which we gather by means of the consent management service (see Section XI.3.a). You may withdraw your consent at any time (see Section III at the end). You may also deactivate the collection of data generated by cookies (including the IP address) relating to your use of the Website and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de. In this case, an opt-out cookie is stored on your device. If you delete cookies, the link must be clicked again.

c. Google Tag Manager
We use Google Tag Manager, a Google service, on our Website to manage cookies and pixels for tracking tools and other tools. The Tag Manager tool is a cookie-free domain and does not collect any personal data. However, it triggers other tags that may collect personal data. If you have made a deactivation at the main or cookie level, this remains valid for all tracking tags that are implemented with Google Tag Manager.
You can deactivate Google Tag Manager with the help of our consent management service (see Section XI.3.a).

d. Google reCAPTCHA
Our Website uses reCAPTCHA from Google to check whether data entry in the contact form on our Website is made by a human or by an automated program. For this purpose, the behaviour of Website users is analysed based on various characteristics. For the analysis, reCAPTCHA evaluates various information, in particular the IP address, the time spent by the user on our Website or mouse movements made by the user. The data collected during the analysis is transmitted to Google.
The legal basis for processing the data for the aforementioned purposes is your consent, which we gather when you check the "I am not a robot" box before submitting the contact form. You may withdraw your consent at any time (see Section III at the end). Kindly note, however, that we also have a legitimate interest in protecting our Website from abusive automated spying and SPAM.

e. Google Maps
We use Google Maps API (Application Programming Interface, "Google Maps") from Google on our Website for the visual display of geographical information (maps). By using Google Maps, information about the use of our Website, including the IP address of the users of the Website, is transmitted to a Google server in the USA and stored there.
The legal basis for the processing of data for the aforementioned purposes is your consent, which we gather by means of the consent management service (see Section XI.3.a). You may withdraw your consent at any time (see Section III at the end). You may also deactivate Google Maps to prevent data transmission to Google by deactivating JavaScript in your browser. In both cases, however, you will not be able to use the map display.

f. Youtube
On our Website, we use plugins from YouTube, a video portal of YouTube LLC, 901 Cherry Ave, San Bruno, CA 94066, USA, a subsidiary of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter "YouTube"), which operates the services in the European Economic Area and Switzerland. We use this plugin to improve the user experience by means of videos.
Each time you access a page that offers one or more YouTube video clips, a direct connection is established between your browser and a YouTube server. This stores information about your visit and your IP address. By interacting with the YouTube plugins (e.g. clicking the start button), this information is also transmitted to YouTube and stored by YouTube. If you have a YouTube user account and do not want YouTube to collect data about you via this Website and link it to your membership data stored on YouTube, you must log out of YouTube before visiting this Website.
In addition, YouTube calls up the analytical tool Google Analytics via an iFrame in which the video is called up (see Section XI.3.b). This is YouTube's own tracking, to which we have no access. The legal basis for the processing of data for the above-mentioned purposes is your consent, which we gather by means of the consent management service (see Section XI.3.a). You may withdraw your consent at any time (see Section III at the end). You may also prevent tracking by Google Analytics by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de. Our company profile on the social media networks LinkedIn, Instagram and YouTube is linked in the footer of our Website. You may recognize the links by the symbol of the respective network. By clicking on the respective symbol (hyperlink), you will be redirected to our profile with the respective provider and the data protection provisions of the respective provider apply (see Section XIII for more information). In order to be able to use the functions of the respective network there, you must log into your user account for the respective network in some cases.
